Terms of Service
This Electronic Bill Presentment and Payments Service (“EBPP” or the “Service”) is being offered by us through our depository bank and one or more third-party vendors. If you are a consumer, your use of the Service to make electronic payments is subject to the consumer banking regulatory protections described in federal Regulation E, which implements the Electronic Fund Transfers Act. Depending on the payment method you select, and regardless of whether you are a consumer or business, your use of the Service may also be governed by the National Automated Clearing House Association (“NACHA”) Rules and Guidelines (“NACHA Rules”). When you elect to view and pay your bills online and open your Service account with us, you, and any person you authorize to perform functions on your Service account, agree to these Terms of Service.
- Erroneous Instructions. If we receive payment instructions authorized by you and the instructions are erroneous in any way, we shall have no obligation or liability for the error.
- Transaction Limitations. Please be aware that certain types of bank accounts have regulatory limits on the numbers of transfers or withdrawals that you may make from them each month. The bank that holds your account from which your payments will be made may refuse transfers that would exceed such limits. Thus, we recommend you check with your bank to determine what limitations are imposed on withdrawals from your account. If we are not able to debit the amount required to cover a payment you have authorized, we will not be able to make the payment you have authorized, and we will not be liable for any costs, fees, damages, etc. that you may incur caused by our inability to make the payment. We have no obligation to try to debit your bank account for a specific payment more than once.
- Authorized Users. If there are other authorized users on your Service or on your bank account(s), you hereby authorize each of them to use this Service. Any signer on such accounts is authorized to make payments, even if your account otherwise requires two or more signatures for withdrawals.
- Business Days. Our business days are Monday through Friday, excluding legal holidays. Payments you make after our daily cut-off time or on a non-business day will be processed on the following business day.
- Electronic Disclosures. If we are required to provide you with disclosures and/or notices mandated by law or regulation, you agree to receive all such disclosures electronically.
- Confidentiality. We will never sell any of your personally identifiable information to a third party for marketing purposes without your consent. We will disclose to third parties information about your Service account, or the transfers or payments you make, only:
- where it is necessary for opening or maintaining your account, or for completing transfers or payments,
- if lawfully required, or
- if you request or authorize it.
- Your Liability. You agree to regularly and promptly review and verify all transactions, either on our EBPP web page or on the monthly statements you receive from either the bank holding your transfer-from account, or your credit card issuer (if you made a payment by credit card). Also, if your bank account or credit card account statement shows transactions by us that you did not authorize, contact your bank or credit card issuer.
- Our Liability. If we do not complete a payment you authorized in a timely manner and in accordance with the provisions of this Terms of Service, we may be liable to you for your direct losses or damages. However, we will NOT be liable when, for example:
- Through no fault of ours, your transfer-from account does not contain sufficient available funds for us to debit to cover the payment due.
- Our EBPP web site or other systems are not working properly.
- Circumstances beyond our control or the control of our agent (such as fire, flood, computer breakdown or problems with a telephone line) prevent or impede the transaction, despite reasonable precautions we have taken.
- Your transfer-from bank account has insufficient funds available, or the funds are subject to legal process or any other encumbrance or claim restricting transfers, at the time we attempt to debit your account for authorized payment(s).
- You have insufficient or no available credit on the credit card account you designate from which to make your payment(s).
- The information you have supplied to us is incorrect, incomplete or not timely.
